Till now we have seen all the shades of media,
all its weak as well as strong points. One thing that we cannot deny at this
point is that the phenomenon of media trial is indeed real and is affecting our
judicial system. Media trials are swapping places with judiciary and that too
with people’s support and faith in them. Its high time when people should
realize that Indian Judiciary is the epitome of justice and there’s no denying
on it. And at the end of the day judiciary should be the body to which all the people turn
to for the delivery of justice because having a fair trial is an essential part
of a fair and just society. The right to a fair trial is the only way a
miscarriage of justice can be averted. So, what can be suggested to address
this issue and at the end reach a fair verdict?
1. Fist of all, Clear guidelines should be set
down for jurors to ensure that they refrain from doing their research on social
media because even if a person is free from any kind of bias there are chances
that he is subconsciously being affected by what media is portraying. Also,
many a times situations are such that by declaring a judgement that is in
contrary to media’s verdict a judge can damage his reputation. Therefore, in
such instance’s things can go the round way. But by adhering to such a rule,
jurors will enter the courtroom without any preconceived notions.
2. the second point is that only accredited
journalists should be allowed to make use of electronic devices during court
proceedings. This helps keep a close grip on the number of journalists that are
permitted to attend current cases and the content they publish by which the
source of credibility can be confirmed.
3. We should be Introducing a 15 mins lag to the
‘live’ tweeting mechanism for the journalists present in court which will
ensure any material that could amount to contempt of court is contained as much
as possible.
